The Supreme Court’s Chamber Court has upheld bail granted to former Chief Justice ABM Khairul Haque, clearing the way for his release from jail.
On Monday, Chamber Judge Justice Md Rezaul Haque passed a “no order” on the state’s petition seeking a stay on the High Court’s bail order in an attempted murder case filed with Banani Police Station.
Following the order, Khairul Haque has bail in all the cases against him, leaving no legal obstacle to his release, his lawyer said.
The state’s petition was heard by the Appellate Division Chamber Court on Monday. Lawyer Mohammad Motahar Hossain Saju represented Khairul Haque, assisted by Monayem Nabi Shaheen, while Deputy Attorney General Syeda Sajia Sharmin appeared for the state.
On August 10, the High Court granted Khairul Haque interim bail in the Banani case and issued a rule asking why he should not be granted permanent bail.
Earlier, on July 2, the Chamber Court had upheld his bail in a murder case filed with Jatrabari Police Station.
The Jatrabari case was filed over the death of a man named Khwaib during the anti-discrimination student protests on August 5, 2024. Khairul Haque was later shown arrested in the attempted murder case filed with Banani Police Station.
He had already secured bail in seven other cases. With bail now remaining in force in all cases, his lawyers say there is no longer any legal barrier to his release.
