HC petition seeks clear guidelines on dower recovery

A public interest litigation (PIL) has been filed with the High Court seeking clear guidelines and a uniform judicial procedure for recovering denmohor (dower) fixed at the time of marriage.

The writ petition was filed on Sunday by Supreme Court lawyer Barrister Fahmida Akhter, naming the law secretary and other relevant officials as respondents.

The petition requests the court to issue a rule asking why authorities should not be directed to formulate and implement comprehensive guidelines under Section 10 of the Muslim Family Laws Ordinance, 1961, regarding the recovery of denmohor.

According to the petition, there is a need for clear provisions on the valuation, recovery process, policy framework and enforcement mechanism for dower payable one year after marriage. It argues that such guidelines would better protect the financial rights and interests of married Muslim women while removing ambiguities in Section 10 of the ordinance to ensure fair and effective justice.
