Senior Supreme Court lawyer Shishir Mohammad Monir has said that Gazi Nazrul Islam, the Member of Parliament elected from the Satkhira-4 constituency on a Bangladesh Jamaat-e-Islami ticket, is unlikely to retain his parliamentary seat following his expulsion from the party.

In a post on his verified Facebook account on Wednesday, Monir commented on the constitutional implications of the expulsion after Jamaat-e-Islami announced disciplinary action against the lawmaker.

The issue came into focus after Jamaat expelled Gazi Nazrul Islam from the party, citing proven moral misconduct following an internal organizational investigation.

According to the party’s official statement, the decision was taken under Article 62 of the Jamaat constitution after the investigation established allegations of “moral turpitude” against the MP.

Responding to the development, Monir argued that the constitutional provision governing the loss of a parliamentary seat should apply in this case.

“Article 70 of the Constitution refers to resignation, whereas he has been expelled,” Monir wrote on Facebook. “Jamaat is informing the Election Commission today because of the moral misconduct. The question is whether he can continue as a Member of Parliament. In my opinion, he cannot.”

The legal expert’s comments have added to the debate over whether the expulsion of an MP from the political party on whose nomination he was elected automatically results in the loss of the parliamentary seat.

Neither the Election Commission nor the Speaker of Parliament has yet made any official statement on the matter. The final decision, if contested, could depend on the interpretation of the Constitution and relevant legal procedures.
