The Appellate Division on Wednesday stayed a High Court order that barred law enforcement from showing an arrested individual in a new case without a specific complaint.
Earlier, a High Court bench comprising Justice Razik Al Jalil and Justice Debashish Roy Chowdhury had ruled that no one should be shown arrested in a case without a clearly defined allegation. The court had also issued a rule seeking an explanation on the matter.
However, the Appellate Division has now suspended that directive and instructed the High Court to dispose of the rule within four weeks.
Attorney General Mohammad Ruhul Quddus Kajal said the High Court order risked hindering independent investigations.
He argued that such a restriction could prevent law enforcement agencies from taking action even when they possess credible evidence against a suspect.
He also noted that the court has set Sunday to hear the matter of showing former Chief Justice ABM Khairul Haque arrested in a new case.
